What You Should Know About Site Agreements If You Are Considering Buying an Established Manufactured Home
The impression is being given by a number of park owners that a new site agreement is essential or desirable when buying the home.
Agreements made before the present Act are 100% legal and do not require replacement by a new agreement.
The making of a new agreement allows the park owner to set the site rent at a higher level that that paid by the previous owner.
It also allows the park owner to insert new clauses such as the requirement to pay up to 14% of the buying (or selling) price to the park owner, if you decide to sell the home at some time in the future.
Despite statements to the contrary by some park owners, the seller has the right to assign the present site agreement to the buyer, so that the present terms will carry over to the new owner.
Before you agree to a new site agreement, check the implications of this with the seller, with MHOA and with your solicitor, and if the terms of the
proposed new agreement deprive you of your rights enjoyed by the seller,
Insist on your right to have the previous agreement assigned to you.
